Résumé

À travers l’analyse d’un contentieux administratif se déroulant dans plusieurs sites, nous décrivons un conflit d’interprétation portant sur l’islamité associée au port de la barbe d’un chirurgien stagiaire au sein d’un hôpital public français. En ce sens, nous étudions l’activation du référentiel islamique dans le cadre de la catégorisation opérée par les acteurs de la scène judiciaire sur l’objet de la barbe, différemment décrit comme étant un « signe religieux » ou un élément « esthétique » relevant du choix personnel de l’intéressé. Nous verrons que la scène judiciaire donne lieu à un désaccord sur la manière de rattacher les faits (et les « objets ») aux catégories du droit : ce conflit juxtapose deux visions opposées des principes de « laïcité » et de « neutralité » du service public.

Abstract

Through the analysis of an administrative dispute taking place in several “dialogical sites” (Leudar and Nekvapil 2002), we describe the conflict between opposing interpretations concerning the “Islamic” frame of reference associated with the wearing of the beard of a trainee surgeon in a French public hospital. In this sense, we study the activation of the “Islamic” frame of reference within the framework of the process of legal classification operated by the actors of the judicial scene on the object of the beard, differently described as a “religious sign” or an “aesthetic” element of personal choice. We will see that the judicial scene gives rise to a “practical-moral disagreement” (Jayyusi 1984) on how to relate facts (and “objects”) to the categories of law : this conflict juxtaposes two opposing visions of the principles of “laïcité” and “neutrality” of public service.
